TERMS AND CONDITIONS

 

Michèle BECKER, painter enrolled in the House of the Artists as No. L177944, proposes to sell art supplies (boxes, magnets, postcards) and occasionally original works via her website.

The general conditions of sale apply to the items herein above. They specify the conditions for orders, payments and shipping of the ordered items.

They can be consulted at any time on the 'terms and conditions' page.

1. CHARACTERISTICS OF THE PROPOSED ARTICLES

The items offered for sale are those listed in the Michèle BECKER online store. Photographs and descriptions of the items are as accurate as possible. It may, however, be some slight differences in colour between the proposed article and the object itself. Michèle BECKER can’t in any way be held responsible for those dissemblances and can’t give the buyer any right to claim.

2. ORDER

By confirming his order, the client acknowledges that he has read and understood these terms and conditions and that he accepts them.

3. AVAILABILITY OF ARTICLES

In case the ordered item is no longer available at the time of sending the order form, Michèle BECKER will inform the customer as soon as possible and make a business proposal within eight days following the order.

4. SALE PRICE

The articles are priced in euro, including shipping costs.

5. PAYMENT AND BILLING

All purchases are payable at the time of order via PayPal. Michèle BECKER reserves the right to pursue any uses or attempts to use fraudulent means of payment.

6. SHIPPING

Delivery will occur within eight working days after the order, to the address specified by the customer while ordering. The order will be shipped by post, mail delivery or Colissimo depending on the value of the ordered items. Michèle Becker will decide the appropriate shipping method and inform the customer by email. In the absence of the customer upon delivery, a notice will be delivered; delivery is considered made at the time of the first presentation to the shipping address specified by the customer while ordering.

7. RIGHT OF WITHDRAWAL

The customer has a withdrawal right during a period of 14 days starting the date of delivery, as indicated in Article 6. During that period, the customer can return at his own expenses the item that does not suit him.

This return will be accepted by Michèle BECKER if:

• The customer has expressly indicated his intention to return the item by phone or by email via the contact page of the Michèle BECKER website.

• The item(s) returned are in their original packaging with the necessary protection to prevent breakage or damage,

• Returned items are sent in one shipment; Michèle BECKER reserves the right to refuse the return of items from a same order but shipped at different times.

If this right of withdrawal is exercised as above, Michèle BECKER will refund the payment received, net of shipping costs for the ordered and returned items within thirty days following the date on which Michèle BECKER became aware of the exercise of the withdrawal right by the customer. No compensation for this cancellation will be given.

8. MAJOR FORCE

Michèle BECKER will not be liable for any breach of her contractual obligations in the event of major force, including disasters, fires, and strikes, internal or external failures and in general, of any unforeseeable and irresistible event that would not allow the efficient execution of orders.

9. USE OF SITE

For online sales, Michele Becker is bound only by an obligation of means, her liability cannot be held for damages resulting from the Internet network such as data loss, hacking, viruses, break of service or any other unintended problems.

10. PERSONAL DATA

According to the law relating to data, files and civil liberties of 06/01/1978, the nominative customer information will be processed by computer. Michèle BECKER reserves the right to collect information about her customers, but without transmitting them to any commercial partners.

Customers have a right to access and correct their data, according to the law of 06/01/1978.

11. ARCHIVING

Michèle BECKER will archive the passed orders in accordance with section 1348 of the Civil Code.

12. APPLICABLE LAW

These online sales terms and conditions are subject to the French law.

Any conflict related to orders placed by customers under the present terms and conditions of sale that could not be resolved amicably shall fall under the exclusive jurisdiction of the court for the place of residence of the buyer. In case the customer does not reside in France, conflicts concerning the business relationship with Michèle BECKER will be subject to the exclusive jurisdiction of the French court.
